CNIPA Calls for Further Standardizing Patent Application Drafting

CNIPA recently issued a document setting out recommendations to patent attorneys with respect to the drafting of patent applications.  The recommendations are intended to promote the standardization of patent applications, thereby increasing efficiency in the patenting process.  

Recommendations

  • Patent application documents should focus on describing technical solutions, with efforts made to exclude content unrelated to the solutions, particularly background technology and drawings in the specifications.
  • The background section of the specifications should clearly state the background technology and corresponding documents that will be useful for understanding, searching, and examining the invention or utility model. The explanation of the problems and shortcomings in the background technology should focus on the technical contents and avoid introducing information that is not directly related to the technology, such as politics, economy, culture, etc.
  • For the drawings of the specification, it is recommended to introduce maps only when they are closely related to the scope of protection. When necessary, the applicant shall use standard maps obtained through, for example, the “Standard Map Service System” on the website of the Ministry of Natural Resources (http://bzdt.ch.mnr.gov.cn) to ensure the accuracy, legality, and authority of the maps. When preparing drawings based on standard maps, relevant laws, regulations, and departmental rules should be followed.
