Experience

Ms. Tian obtained her Master’s degree from China University of Political Science and Law, and joined the firm in 2014.

Ms. Tian is experienced in handling a wide range of contentious and non-contentious intellectual property matters in China, including prosecution and enforcement of IP rights, portfolio management, trademark clearance, as well as customs IP issues and domain name disputes.

Ms. Tian represents multinational companies and Fortune 500 clients before the administrative IP authorities and the Chinese courts. Ms. Tian’s IP experience extends across a number of key sectors, including industrial products, consumer products, finance, travel and hospitality, computer and software products, telecommunications, and other sectors

Work Highlights

  • Won court appeals representing Freudenberg before the Beijing IP Court, the Beijing High Court and the China Supreme Court, obtaining favorable judgments on the key issue of affirming relatedness between goods in different classes and mark similarity between English and Chinese marks.
  • Won court appeals representing Klueber before the Beijing IP Court and the Beijing High Court, obtaining favorable judgments on the key issue of affirming relatedness between goods in different classes.
  • Won court appeals representing Alltech before the Beijing IP Court and the Beijing High Court, obtaining favorable judgments affirming mark similarity.
  • Won several invalidation actions before the CNIPA representing WhatsApp, removing pre-emptive registrations while clearing the path for the registration of the client’s own marks in core classes.
  • Won several dozens of oppositions and invalidation actions before the CNIPA representing EagleBurgmann, preventing squatters from securing registration and removing bad faith marks from register, obtaining recognition of the fame of the client’s trademarks and house marks, and safeguarding the client’s goodwill.
  • Won several opposition and invalidation actions before the CNIPA representing Gilead, removing bad faith marks by squatters to safeguard the client’s goodwill.
  • Won multiple domain name complaints under UDRP policy and CNDRP policy, representing world leading companies in various industries.
