Examiner at the TRAB, 2011 – 2016

As a trademark examiner at the TRAB, Mr. YIN has reviewed more than 5,000 trademark adjudication cases and participated in over 300 administrative litigation proceedings, winning awards for Excellent Examiner for three consecutive years from 2013 to 2015.

Since joining in East IP since 2016, Mr. Yin has been responsible for trademark prosecution and litigation in China and overseas trademark matters for multinational companies and startup, such as CATL, Simmons, BSH, Epson, Sekisui Chemical, JVC, among others.

Work Highlights

  • Won court appeals before the Beijing IP Court and the Beijing High Court representing Lock & Lock, obtaining favorable judgments to invalidate bad faith registrations.
  • Won court appeals before the Beijing High Court representing NucTech, in which the court rendered favorable judgments overturning first instance judgments and CNIPA decisions and supporting our position of dissimilarity of marks and goods.
  • Won court appeals before the Beijing High Court representing Meitu, helping the client secure trademark registration of its house mark “MEITU” in Chinese.
  • Won court appeals before the Beijing IP Court and the Beijing High Court representing Lonely Planet, obtaining favorable judgments to invalidate bad faith marks as pre-emptive registration of marks already used by others despite them having obtained a certain level of fame.
  • Won a trademark administrative penalty case representing EagleBurgmann before the Jiangsu Intermediate Court, which upheld the administrative decision to sanction the other party’s trademark infringement.
  • Won a trademark infringement and anti-unfair competition case representing NOK in the Shanghai High Court, in which NOK was recognized as a well-known mark and the Court awarded NOK a compensation of RMB 1 million.
