Ms. Yuan obtained her Master’ Degree of Civil and Commercial Law from Beijing Institute of Technology and joined in the firm in 2014.

Ms. Yuan represents clients ranging from startups, to Fortune 500 multinational corporations in internet, technology, social networking and other industries.

Ms. Yuan has handled hundreds of trademark prosecution matters before the CNIPA, numerous trademark court appeals before the Beijing IP court, the Beijing High Court and the China Supreme Court. She also handles various domain name disputes, online takedowns, IP-related customs matters and other intellectual property law matters.

Work Highlights

  • Won court appeals representing Tommy Bahama in regard to serial “TOMMY BAHAMA” marks in core classes; successfully represented client to overturn unfavorable first instance and second instance court decisions based on Article 41 of “obtaining registrations by other unfair means” before the China Supreme Court.
  • Won court appeals representing Facebook against bad faith filings in various classes, obtaining favorable court decisions affirming the high degree of fame of Facebook’s trademarks and the corresponding relationship between the English mark and Chinese equivalents.
  • Won court appeals representing Facebook and its affiliates before the Beijing IP Court, the Beijing High Court, the China Supreme Court, obtaining favorable court decisions approving the registrations of Facebook’s new brands.
  • Won various oppositions and invalidations before the CNIPA representing Yuga Labs, removing pre-emptive registrations while clearing a path for the registration of the client’s own marks in core classes, preventing infringement on its prior copyright.
  • Won multiple domain name complaints under the UDRP and CNDRP policies, representing the world leading companies in various industries.
