{"id":3262,"date":"2025-05-01T00:01:53","date_gmt":"2025-04-30T16:01:53","guid":{"rendered":"https:\/\/east-ip.com\/?p=3262"},"modified":"2025-06-04T16:08:39","modified_gmt":"2025-06-04T08:08:39","slug":"trademark-prosecution-update","status":"publish","type":"post","link":"https:\/\/www.east-ip.com\/zh\/insights\/trademark-prosecution-update\/","title":{"rendered":"Trademark Prosecution Update"},"content":{"rendered":"<p>This memo offers brief updates on trademark prosecution in the PRC.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bad Faith Registration<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>See <a href=\"https:\/\/www.east-ip.com\/zh\/insights\/civil-litigation-strategies-against-bad-faith-trademark-pirates\/\" data-type=\"post\" data-id=\"3130\">\u66f4\u591a\u4fe1\u606f\u53c2\u89c1\u6b64\u5904<\/a> for East IP\u2019s April 2025 survey of recent civil decisions in China where trademark owners have secured compensation and other remedies based upon unfair competition.&nbsp;These civil actions are pointing the way towards new best practices for dealing with bad faith filers.&nbsp;For example, two courts have imposed joint and several liability against trademark agents representing bad faith pirates.&nbsp;Two courts have also ordered pirates to pirate de-register all pirate marks they continue to own \u2013 thus avoiding the need for invalidation actions by the victim brand owner.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Overall, oppositions and invalidation actions are becoming easier to win.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Case decisions have recently been issued that suggest marks registered by certain pirates can be invalidated even after the five-year time bar imposed by current law.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Higher Chances of Rejection<\/h2>\n\n\n\n<p>The Trademark Office (TMO), the Trademark Review and Adjudication Division (TRAD) and the courts are continuing to reject more and more applications based upon absolute grounds as well as a larger number of citations, ostensibly based upon a policy introduced in 2023 intended to reduce the overall number of new marks approved in China. Trademark owners need to keep the heightened risk of rejection in mind when strategizing on new filings. Early filing is recommended to allow time for dealing with possible refusals.
